Welcome to Web2Phone, a backup and synchronization service for content on your mobile phone(s). The Web2Phone site and service are operated by ObexCode AS. By using the Web2Phone web site at sync.obexcode.com you signify that you have read, understand and agree to be bound by these Terms and Conditions whether or not you are a registered member of Web2Phone. If you don’t agree to these terms and conditions, you can not use the service. By signing up you also verify that you are old enough to enter into a legal obligation. You also agree to ensure that anyone who uses this software on your computer also abides by the Terms and Conditions.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS. THESE INCLUDE VARIOUS LIMITATIONS AND EXCLUSIONS, AND A DISPUTE RESOLUTION CLAUSE THAT GOVERNS HOW DISPUTES WILL BE RESOLVED.

Description of Service, Signup and Usage

Web2Phone offers the ability to backup and synchronise your mobile phone(s). This synchronisation enables you to manage content on mobile phones from the Web2Phone web site and create a backup of the content and restore this to new mobiles. The service is generally free, though some additional features, however, may be offered at a cost. ObexCode reserves the right to charge for the service, in full or in part, with a 30 days notice announced in a clearly visible place at the web site.

You sign up for the service through the Web2Phone web site. Signing up entitles you to a personal license to use the Web2Phone service. The license is personal and cannot be transferred or redistributed to another legal entity.

The license gives you the right to use the service for a fixed period or as a subscription with automatic renewal. The service may be provided either free of charge or paid up front for a specified period. You can cancel your subscription at any time when the current subscription period expires. When the subscription is cancelled access to the web site is blocked.

Service Availability and Disclaimers

The site and service is provided “as is” and you agree to use it at your own risk. The site and the service may be temporarily unavailable from time to time for maintenance or other reasons. ObexCode assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user communications. ObexCode is not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers, computer or mobile phone equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any site or combination thereof, including injury or damage to the usser's or to any other person's computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the web and/or in connection with the service.

ObexCode is not responsible or liable in any manner for to you or a third party for loss or damages arising out of using the service. ObexCode is not responsible for the conduct, whether online or offline, of any user of the site or service.

ObexCode reserves the right to change any and all content, software and other items used or contained in the site and any services offered through the site at any time without notice. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation therewith, by ObexCode.

Termination

ObexCode may terminate your membership, delete your profile and any content or information that you have provided to the site or service and/or prohibit you from using or accessing the service or the site (or any portion, aspect or feature of the service or the site) for any reason, or no reason, at any time in its sole discretion, with or without notice, including without limitation if it believes that you are not eligible to use the site or service. Such notice can be given on web, by email or SMS. If the service is terminated while the user is having active accounts a relative portion of the payment shall be paid back.

ObexCode has the right to cancel a subscription if the account is being used for unlawful activities.

Third Party Information

The site or service might contain links to other web sites, as well as include content and advertisements from third parties. Such third party sites and content are not investigated, monitored or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any third party sites accessed through the site or any third party content available through the site, including without limitation the content, accuracy, offensiveness, opinions, reliability, privacy practices or other policies of or contained in the third party sites or content. Inclusion of, linking to or permitting the use of any third party site or content does not imply approval or endorsement thereof by us. If you decide to leave the site and access the third party sites or content, you do so at your own risk and you should be aware that our terms and policies no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any site to which you navigate from the site.

Updates to the Terms and Conditions

ObexCode reserves the right, at our sole discretion, to change, modify, add, or delete portions of these Terms and Conditions at any time without further notice. If we do this, we will post the changes to these Terms and Conditions on this page. Your continued use of the service or the site after any such changes constitutes your acceptance of the new Terms and Conditions. If you do not agree to abide by these or any future Terms and Conditions, do not use or access (or continue to use or access) the service or the site. Governing Law; Venue and Jurisdiction

These terms and conditions are governed by Norwegian law. All legal matters arising from or related to the use of the site or service shall be interpreted in accordance with (and all questions with respect to that shall be determined by) the laws in force in Norway applicable to contracts entered into and wholly to be performed within Norway, unless it has been explicitly declared to the contrary somewhere else.
